All orders placed on the website are subject to these general terms and conditions of sale.
Mkdo Company reserves the right to adapt or modify these terms at any time, with the version of the general terms and conditions of sale applicable to any transaction being the one appearing online on the mkdogames.com website at the time of order.

I The Customer

The Customer declares that they are a natural person, at least 18 years old and have the legal capacity or hold parental authorization allowing them to place an order on the website. When registering the Customer's personal data in the "my account" section, they must ensure the accuracy and completeness of the mandatory data they provide. In case of error in the wording of the recipient's contact details, Mkdo Company cannot be held responsible for the inability to deliver the product. Mkdo Company reserves the right to cancel any order when the customer's IP address is domiciled in a country different from the billing and/or delivery address.

II The Products

The products offered for sale are those described on the Site. Mkdo Company takes great care in the presentation and description of these products to best satisfy the Customer's information needs. However, it is possible that non-substantial errors may appear on the Site, which the customer acknowledges and accepts. In any event, in case of non-conformity of the delivered product compared to its description on the Site, the Customer may either exercise their right of withdrawal, or implement Mkdo Company's conformity guarantee which will proceed, if applicable, either to exchange or refund the price (in whole or in part) possibly charged.

III The Order

Order placement on the Site is subject to compliance with the procedure established by Mkdo Company, materialized by a succession of different steps that the customer must follow to validate their order. The customer will have the opportunity, before finally validating their order, to verify its details and total price, and to correct any errors, before confirming it to express their acceptance. Any order confirmed by the Customer constitutes a sales contract and acceptance of all the provisions hereof.

Mkdo Company will refuse any order from a customer with whom there is a dispute or incident relating to payment of a previous order or which would contravene the provisions hereof.

Dans cette hypothèse, la Société Mkdo informera par courrier électronique le Client. A défaut pour le client de procéder auprès de la Société Mkdo à la correction des éléments erronés ou contraires aux présentes conditions générales de vente, la Société Mkdo se réserve le droit de ne pas traiter la commande.

Un email de confirmation récapitulant la commande (produits, prix, disponibilité des produits, quantité…) sera adressé au client par la Société Mkdo. A cet effet, le client accepte formellement l’usage du courrier électronique pour la confirmation par la Société Mkdo du contenu de sa commande. En tout état de cause, les factures sont remises lors de la livraison.

IV Price and Payment Terms

1. Price Determination

Product prices are indicated in euros, all taxes included for mainland France and the European Union, excluding shipping costs.

The total order price (all taxes and shipping costs included) is indicated in the basket.

For overseas departments, Switzerland and all other countries outside the European Union, the displayed selling prices are deemed to be tax-free and therefore cannot be subject to VAT deduction. The customer acknowledges that they are considered the official importer and may, depending on the country or overseas department of delivery chosen at the time of order, have to pay customs duties and/or import duties according to the legislation in force in the said country or overseas department.

La Société Mkdo se réserve le droit de modifier ses prix à tout moment mais les produits seront facturés sur la base des tarifs en vigueur au moment de l’enregistrement de la commande, sous réserve de disponibilité.

2. Payment Method

Products are payable in full on the day of actual order.

Payment for purchases is made by either:

- Carte bancaire Le Client accède à un espace dédié mis à disposition par un établissement bancaire (Payplug), lequel assure la sécurité et l’enregistrement de l’ordre de paiement. 
- Paypal

3. Les données enregistrées et conservées par la Société Mkdo constituent la preuve de la commande et de l’ensemble des transactions passées. Les données enregistrées par le système de paiement constituent la preuve des transactions financières.

V – Delivery

Delivery is made to the delivery address indicated by the customer, it being specified that this must be the customer's residential address or that of any other natural person of their choice.

Delivery cannot be made to hotels or post office boxes.

In order for these time frames to be met, the customer must ensure they have provided accurate and complete information regarding the delivery address (such as, in particular: street number, building number, stairwell number, access codes, names and/or intercom numbers, etc.).

The stated time frames are indicative time frames, corresponding to average processing and delivery times.

La Société Mkdo ne pourra être tenu responsable des conséquences dues à un retard d’acheminement n’étant pas de son fait.

En cas de colis endommagés (déjà ouvert, produits manquant…), le Client s’engage à notifier au transporteur et à la Société Mkdo par tous moyens, toutes réserves dans les 3 jours suivant la réception du produit.

VI – Right of Withdrawal

The individual Customer has a right of withdrawal, which they can exercise without reason, within fourteen (14) clear days from delivery of the order, which will be exercised by returning at their own expense the new products (never used, in their original packaging) after obtaining a return agreement number from Mkdo Company.

La Société Mkdo remboursera au Client les éventuelles sommes déjà versées, déduction faite des éventuels frais d’expédition, dans les conditions visées à l’article VII suivant.

VII – Refund

Les remboursements des produits dans les hypothèses visées à l’article II et VI seront effectués par la Société Mkdo dans un délai maximum de 30 jours après la réception par elle desdits produits. Le remboursement s’effectuera suivant le même mode de règlement choisi par le client au moment de sa commande ou par la remise de bon d’achat.

VIII- Applicable Law

Any order automatically binds the customer to the General Terms and Conditions of Sale. These general terms and conditions of sale are governed by French law. In case of dispute, only French courts will have jurisdiction. In case of difficulty or complaint regarding an order, the customer can contact Customer Service to find an amicable solution.

IX – Data Protection

Les informations collectées par la Société Mkdo lors d’une commande du client sont nécessaires à la gestion de la transaction et à cet effet pourront être communiquées en tout ou partie aux prestataires de la Société Mkdo intervenant dans le cadre de l’exécution de la commande. Le client est informé que ces mêmes données à caractère personnel pourront également être collectées par un organisme en charge de l’analyse des commandes et de la lutte contre la fraude à la carte bancaire. Conformément à la loi Informatique et Libertés n°78-17 du 6 janvier 1978, le client dispose d’un droit d’accès, de rectification, d’opposition et de suppression aux données le concernant.
